The meeting of the still-hot military operations and intelligence commission did not end without "cracks". Between the Civic Movement and the Socialist one, represented by MP Spartak Braho, there was a debate over the first election. After this battle over SHIK, the intelligence service draft was returned from nine-six to the articles that aim to take it out of direct parliamentary control. This is the first part of the bill for the creation of the secret service.
To enter the race with the government, parliament had to include the main article on parliamentary oversight. This is the most delicate part of the discussion about the structure of SHIK.
In the latest draft, Nano's government has decided to create a SHIK without parliamentary control. This is shown by the provisions linking the leaders to the authority of the Prime Minister. Under the heading "Appointment of the director," it is stated that a person will be appointed at the head of this service upon the proposal of the Prime Minister. According to another point, the head of government will have the right to dismiss him.
These two formulations would give the Prime Minister almost complete control over SHIK, leaving the President and Parliament outside the system of checks and balances. In this sense, the return of the law by the head of state has opened a broad debate on the relationship between powers.
The President has pointed out that some articles are contrary to the rights and freedoms of Albanians. According to him, certain provisions of the draft law undermine constitutional principles and place an excessive dependence of this institution on the executive.
The debate over SHIK has taken on broad political dimensions and is expected to continue in the next parliamentary sessions.
